Returns Of The Items Bought Online
In
addition to the exceptions established by the legislation of Georgia and this
policy, the customer has the right to refuse a distant contract and/or an
off-site contract within 14 calendar days without specifying any reason. This
term is counted as of:
a.
In
the case of service contract – as of the date of the contract conclusion;
b. In the case of purchase contract
- from taking possession of the goods by the customer or a third party
designated by him/her (except the carrier);
c.
In
the case of partial ordering of goods by the customer - from the moment the
last item is taken into possession by the customer, or a third party specified
by him/her (except the carrier);
d. In the case of a contract for
the regular (determined periodicity) delivery of goods - from the first time
the customer or a third party designated by him/her (except the carrier) takes
possession of the item.
In
case of cancellation of the contract by the customer, he/she will not be
charged any costs (including delivery costs), unless the customer has chosen a
more expensive delivery service than the standard delivery service offered by
JSC "Elit Electronics" or the price of the goods has reduced as a
result of a use that is not related to the determination of the nature,
characteristics and functionality of the goods. The obligation to cover the
difference arising from the reduction in the price of the goods will not be
borne by the customer, if JSC "Elit Electronics" has not provided
him/her with full information about the right to refuse the contract provided
for by this law.
Rejection
of the remote contract by the customer automatically results in his/her
withdrawal from the related contract and restoration of the original state.
The
customer is obliged to send to JSC "Elit Electronics" a completed
form or other unequivocal evidence, which reflects the customer's decision to
return the goods within the above-mentioned period. The customer bears the
burden of proving the right to withdraw from the contract within the specified
period.

JSC
"Elit Electronics" has the right to receive the form provided above
electronically. Information about the acceptance of the mentioned form will be
provided to the customer immediately, on a durable form.
The
customer can exercise the right to withdraw from the contract within the period
established above if he/she has sent a notice of withdrawal to JSC "Elit
Electronics" before the expiration of the mentioned period. The burden of
proving that the right to withdraw from the contract has been exercised in
accordance with this article rests with the customer.
If
JSC "Elit Electronics" does not inform the customer about the right
to return the goods or services stipulated by this law, the said goods or services
can be returned within 12 months after the expiration of the period established
by the first paragraph of this article.
If
JSC "Elit Electronics" provided the customer with information about
the right to withdraw from the contract within 12 months as of the date
established in the first paragraph of this article, the 7-day period for
returning the goods or services will be counted from the receipt of the said
information.
The
customer does not have the right to refuse the contract if:
a.
JSC
"Elit Electronics" fully provided the services stipulated in the
contract, it started providing the services with the prior consent of the
customer and the customer knew that in case of full acceptance of the service,
he/she would lose the right to refuse the contract;
b. The contract stipulates that the
price of the delivered goods or services depends on the changes on the
financial market, which JSC "Elit Electronics" cannot control, and
which occurred within the period established by this law for the exercise of
the right to refuse the contract;
c.
The
delivered goods or services are made to the customer's individual order or
clearly tailored to his/her personal needs;
d. The delivered goods are
perishable or have a short shelf life;
e. The customer was delivered
hermetically sealed goods, the hermeticity of which was broken after delivery
and, therefore, the goods cannot be returned due to compliance with health or
hygiene norms;
f.
The
delivered goods, due to their characteristics, were inseparably combined with
other goods at the time of delivery;
g.
In
accordance with the terms of the contract, the customer called the vendor to
provide emergency repair/maintenance services. This limitation does not apply
to additional services provided within the scope of this visit beyond the
mentioned services;
h. A sealed audio or video
recording or software was delivered, and its seal was broken after delivery;
i.
The
contract was concluded as a result of a public auction;
j.
A
contract was concluded for the transfer of real estate for non-residential
purposes, transportation of goods, rental of a vehicle, organization of meals
or services related to recreation, and it specifies a defined date or period of
execution of the contract;
As
a result of the refusal of the contract, the obligations assumed by the parties
under the distant contract or the off-site contract are nullified, and what the
parties received by performing it is returned to them.
In
case of refusal of the contract, JSC "Elit Electronics" is obliged
to:
a.
The
amount paid to the customer, as well as, if any, the amount paid to compensate
for the cost of delivery shall be returned in full, without delay, no later
than 14 calendar days after receiving the notice of withdrawal from the
contract. JSC "Elit Electronics" is not obliged to return to the
customer the amount paid to compensate for the additional costs associated with
the customer choosing a non-standard or more expensive delivery service than
the delivery service offered by JSC "Elit Electronics";
b. To reimburse the amount with the
same means of payment that the customer used unless the customer agrees to use
another means of payment and it does not incur additional costs.
3.
In case of cancellation of the purchase contract, JSC "Elit
Electronics" has the right to refuse to refund the money until it has
returned the goods or received a document confirming the shipment of the goods
from the customer, whichever is earlier, unless the seller himself has taken
responsibility for the return of the goods.
In
case of refusal of the contract, the customer is obliged to:
a.
to
return the goods to JSC "Elit Electronics" or to a third party
designated by it immediately after sending the notice of withdrawal from the
contract, but no later than 7 calendar days, unless JSC "Elit
Electronics" itself undertook to take back the goods;
b. to pay only the direct
(immediate) costs related to the return of the goods, unless JSC "Elit
Electronics" itself undertook to pay this cost or did not inform the
customer that this cost would arise in the case of returning the goods. In the case of an off-site
contract, when the goods are delivered to the customer's home, JSC "Elit
Electronics" is obliged to take the goods back at its own expense, if, due
to the nature of the goods, it is impossible to send them by post.
